I am going through a divorce and face extreme hardship although I have a quite good salary (we have 2 young children). I signed up for a loan for my wife prior to our marriage in order to help her to build up her business. Since we were going to be married I did not insist on any documents, although I can of course demonstrate that a good chunk of that money went straight into her business (before marriage). In addition i signed up for a car loan, believing that our marriage would actually prevail a bit more than half a year.
During marriage, she spent quite a lot of money on her new business (still part of the old company) while the investment from the loan is pretty much gone (and so is her business idea in regard to this loan).
Now: I have to pay child support while she is still trying to get her business up, and eventually she reinvests any revenue back into her business. I would prefer if she would have a job, but she refuses, since she still believes (“knows”) it will work out. So, this leaves me with paying child support to an unemployed ex-wife, and I am wondering if anybody would actually consider that I am sitting on payments for loans which I took FOR HER, or if the court would not care at all.
I do know, that signing up for a loan without written agreement prior marriage was stupid, so please no comments on that. All what I am asking here is: are circumstances like the one described actually considered when it comes to the determination of child support or do I have to declare bankruptcy on top of this mess me and my children are in anyway?
