When Can You Be Awarded Spousal Maintenance-Alimony

Arizona refers to alimony as spousal maintenance.
To be awarded spousal maintenance, the courts must first determine whether a spouse is entitled to it.
Are You Entitled to Spousal Maintenance?
Arizona courts may grant spousal maintenance for either spouse seeking maintenance if any of the following conditions are met:
• A spouse lacks sufficient property to provide for their reasonable needs
• A spouse is unable to attain self-sufficiency via employment or lacks the earning ability in the market to become self-sufficient
• A spouse is custodian of a child of such an age or condition that the spouse should not be required to find employment outside the home
• A spouse contributed to the other spouse's educational opportunities
• The marriage was "of long duration" and the spouse is advanced in years, which may prevent the spouse from finding employment to make them self-sufficient

If a spouse does qualify for maintenance by meeting any of these conditions, the court must then determine both the amount and duration of spousal maintenance payments.
