The Uber cabbie accused of raping a young female passenger in India's turned the spotlight again on the online taxi service for the wrong reasons.

Cabbie Shiv Kumar Yadav was arrested on Sunday after the alleged victim complained to police.

She says she was warned not to report the attack but she noted the driver's number and took a snap of his car.

Police say Uber failed to carry out background checks on him or to ensure that his taxi was fitted with a GPS tracker device.

Investigators are threatening legal action against Uber.

The company says India has no defined rules for background checks on commercial transport licences.

It says it's working with the government to resolve the problem.

Uber's already faced critical news coverage of its driver screening in the U.S.
