The Difference Between A Chapter 7 and Chapter 13 Bankruptcy

Chapter 7 and Chapter 13 Bankruptcy are different. First of all, because they deal with different parts of the Bankruptcy Code. In Chapter 7 Bankruptcy, a trustee is appointed to oversee your case, gather all your assets and liquidating those assets, if needed. However, with the majority of cases that we see, no assets are actually liquidated and you don't lose any of your property. In a Chapter 13 case, the trustee creates a payment plan, where you'll repay your creditors a certain portion of the debt that they were owed within a spread and span of three to five years.
